1. Who you are buying from

95confident is a software service operated and sold by Market Your Products, Inc., a corporation registered in California, United States ("we," "us," "our," or "the Supplier"). Your contract for both the service and the purchase is with us directly.

Card payments are processed on our behalf by Stripe, Inc. ("Stripe"), our payment processor. Stripe receives your card details to charge your payment method and will appear on your card statement together with our business name. Stripe is a payment processor, not a reseller — they do not act as Merchant of Record. Sales tax and any applicable VAT/GST are our responsibility as the seller and are added at checkout where required.

2. What 95confident is

95confident is a software-as-a-service tool that uses artificial intelligence to ask you structured questions and generate written strategy reports based on your answers. The reports are produced by large language models and are intended as decision-support material — a starting point for your own thinking, not a substitute for professional advice.

You agree that:

• 95confident is a software tool, not a consulting firm.
• The reports it produces are AI-generated and may contain errors, omissions, or outdated information.
• You will review every report with your own judgment before acting on it.
• We do not guarantee any business outcome, revenue result, or strategic success from using 95confident.
• If you need licensed legal, financial, medical, tax, or regulatory advice, you must consult a qualified human professional. 95confident's reports are not such advice.

3. Your account

To use 95confident you must create an account. You agree to:

• Provide accurate information when you sign up.
• Keep your password secure and not share your account.
• Be at least 18 years old (or the age of majority in your jurisdiction).
• Use the service for lawful business purposes only.

One subscription is for one user. If you need team access, contact us about team plans.

4. Subscription, billing, and renewals

Plan: $49 per month, billed monthly. Prices are exclusive of applicable taxes; we calculate and add the correct tax for your billing location at checkout where required.

Renewal: Your subscription renews automatically each month on the same calendar day until you cancel. You authorize us (and Stripe as our payment processor) to charge your payment method on each renewal.

Cancellation: You may cancel any time from your account settings (which opens the Stripe billing portal) or by contacting us. Cancellation stops the next renewal — your access continues through the end of the current billing month.

Failed payments: If a renewal payment fails, Stripe will retry on our behalf. If payment cannot be collected, your access may be suspended until billing is current.

Price changes: We may change subscription pricing with at least 30 days' notice by email. New pricing applies on your next renewal after the notice period.

5. Refunds

Refunds are governed by our Refund Policy. In short: 30-day money-back guarantee for new subscribers who have generated fewer than 3 reports. See the policy for full terms.

Approved refunds are issued through Stripe back to your original payment method and typically appear on your card within 5–10 business days depending on your bank.

6. What you can and cannot do with the service

You may:

• Use 95confident to generate reports for your own business or your clients' businesses.
• Share, publish, or repurpose the reports you generate. The output is yours.
• Quote 95confident in your own work with attribution where helpful.

You may not:

• Resell 95confident access or share your login.
• Reverse-engineer, decompile, or attempt to extract the underlying prompts, models, or system architecture.
• Use 95confident to generate content that is unlawful, defamatory, harassing, infringing, or designed to deceive (deepfake content about real people, financial scam material, content targeting minors, etc.).
• Use 95confident to make decisions about credit, employment, housing, healthcare, insurance, or other consequential matters where AI use is regulated. 95confident is for general business strategy work only.
• Submit other people's confidential information or personal data into 95confident without their permission.
• Use automated tools to extract content from 95confident or to generate reports at scale beyond normal human use.

We may suspend or terminate accounts that violate these rules.

7. AI-specific terms

Because 95confident is an AI product, you specifically acknowledge:

• Output is generated, not retrieved. Reports are produced fresh each time by language models. The same questions may produce different answers across sessions. We do not maintain a "correct answer" library.
• Output may be wrong. Language models can produce confident-sounding statements that are factually inaccurate, internally inconsistent, or outdated. You are responsible for verifying anything you act on.
• Output may overlap. Because models are probabilistic, two users asking similar questions may receive similar reports. Output is not guaranteed to be unique.
• You own your output. Subject to these Terms and applicable law, you own the reports 95confident generates from your inputs. We claim no copyright over your reports.
• We may use anonymized inputs to improve the service. We may use the questions you answer and the reports you generate, in aggregated and de-identified form, to improve our prompts, evaluate model performance, and train internal systems. We do not sell your inputs. We do not use your inputs to train third-party foundation models. See our Privacy Notice for details and how to opt out.
• We use third-party AI providers. 95confident sends your inputs to large language model providers (currently OpenAI and Anthropic) to generate reports. These providers have their own data handling terms, which we have reviewed and accepted on your behalf as part of operating the service.

8. Confidentiality and data

What you type into 95confident is yours. We treat it as confidential and handle it according to our Privacy Notice.

Do not enter highly sensitive information (government ID numbers, financial account credentials, protected health information, attorney-client privileged material) into 95confident. It is not designed for that.

9. Service availability

We aim for high uptime but do not guarantee uninterrupted service. We may take the service offline for maintenance, updates, or to fix problems. We will give reasonable notice when we can. Extended outages may qualify for refund consideration on a case-by-case basis.

10. Intellectual property

95confident — the name, the website, the question architecture, the prompts, the visual design, the modules, and the underlying software — is owned by Market Your Products, Inc. You receive a limited, non-exclusive, non-transferable license to use the service while your subscription is active. You do not receive any ownership rights in the software itself.

11. Disclaimers

To the maximum extent permitted by law:

• 95confident is provided "as is" and "as available."
• We make no warranties — express, implied, statutory, or otherwise — including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
• We do not warrant that reports will be accurate, complete, current, error-free, or suitable for any particular decision.
• We do not warrant that the service will be uninterrupted or secure.

Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the above exclusions apply only to the extent permitted.

12. Limitation of liability

To the maximum extent permitted by law:

• Our total liability to you for any claim arising out of or relating to 95confident or these Terms is limited to the amount you paid us in the 12 months before the claim arose, or USD $100, whichever is greater.
• We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, lost business opportunities, or business interruption — even if we were advised such damages were possible.
• We are not liable for decisions you make based on 95confident reports.

This section does not limit liability that cannot be limited under applicable law (e.g., for fraud, willful misconduct, or death/personal injury caused by negligence in jurisdictions where such limitation is prohibited).

13. Indemnification

You agree to indemnify and hold harmless Market Your Products, Inc., its officers, employees, and contractors from any claim, loss, or expense (including reasonable attorneys' fees) arising from:

• Your use of 95confident in violation of these Terms.
• Content you submit that infringes someone else's rights or violates law.
• Your use of 95confident reports to make decisions that harm a third party.

14. Termination

You can stop using 95confident any time by canceling your subscription.

We may suspend or terminate your account if you violate these Terms, fail to pay, or use the service in a way that creates legal or operational risk for us. We will give notice when reasonable. On termination, your right to use the service ends. Reports you have already exported remain yours.

15. Changes to these Terms

We may update these Terms. Material changes will be communicated by email at least 14 days before they take effect, and the "Last updated" date at the top will change. Continuing to use 95confident after changes take effect means you accept the new Terms.

16. Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or 95confident will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

If you are a consumer in the European Union, United Kingdom, or another jurisdiction with mandatory consumer protections, those protections apply to you despite the choice of law above.

For payment-related disputes, you may also have rights through your card issuer's chargeback process.
